You may not copy, edit, transmit, distribute, publicly perform, display, reuse, or sell any of the Contents of this website for any public or commercial purpose. The Contents of this website cannot be used on any other website or in any other networked computer environment.

Under no circumstances will Conquest Graphics be liable to you in any way for any Content you may be exposed to that you may find offensive, indecent, or objectionable. Products are provided for your personal use only. You agree to abide by these terms of service and not to use these products and services or related messages for any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.

You agree that you are responsible for protecting your password and controlling access to your registered account. You agree that you will be responsible for all orders placed or other actions that are taken through your registered account.

You acknowledge that Conquest Graphics does not pre-screen , but that Conquest Graphics and its affiliates shall have the right (but not the obligation) in their sole discretion to remove any that violates the terms of service or may otherwise be objectionable. You further acknowledge and agree that Conquest Graphics may preserve and may also disclose if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that the violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Conquest Graphics, its users and the public.

GOVERNING LAW

Conquest Graphics is based in Richmond, VA and all transactions take place on Conquest Graphics's servers located in Richmond, VA. Therefore, this website shall be governed entirely by the laws of the Commonwealth of Virginia. Any legal action or proceeding relating to or arising from your access to or use of this website shall be executed in Richmond, VA. You agree to submit to the jurisdiction of the Richmond, VA state and federal courts and agree that venue in these courts is proper in any such legal action or proceeding.

LIMITATION OF LIABILITY

In no event shall Conquest Graphics or its licensors, suppliers, or vendors, their officers, directors, employees, or agents, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data or profits, whether or not Conquest Graphics has been advised of possibility of the damage, arising out of or in connection with the use or performance of the website or of failure to provide products and services that you order from Conquest Graphics or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall Conquest Graphics be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of the website or its Content.

SEVERABILITY

If any provision of this agreement is found to be invalid, illegal, or otherwise unenforceable, the validity, legality, or enforceability of the remaining provisions shall not be affected in any way.

We reserve the right to refuse service to any party or person, at any time, without disclosing the reasons for refusal of service.

PRICING

Pricing is subject to change at any time up until the point that your order is submitted.

ORDER APPROVAL

The customer is fully responsible for final proof and layout approval prior to the printing process.

Conquest Graphics is NOT LIABLE for errors in a final product caused by any of the following, including, but not limited to:

Misspelling, Graphics, Bleeds, Grammar, Damaged Fonts, Punctuation, Wrong Cuts, Incorrect or Missing Folds, Finished Product Size

ORDER CANCELLATION

Conquest Graphics accepts cancellation of orders prior to approval of a proof. We will promptly inform you of any cancellation charges that may apply. Upon cancellation, any costs (labor, administrative fees, credit card fees, etc.) already borne by Conquest Graphics will be subtracted from your refund.

COLOR PROOFING AND MATCHING

All printed materials are manufactured according to industry standard ink and colorant densities. Exact match to soft (screen) proofing methods is not possible. Conquest Graphics is not liable for color matching or ink density on screen proofs approved by customers. Screen proofs will predict design layout, text accuracy, image proportion and placement, but not color match or density.

Conquest Graphics uses the very latest high-quality reproduction equipment and techniques. We do our very best to match gradient densities of each color to ensure quality results. However, color perception is very subjective, and Conquest Graphics is not liable for the final appearance of printed colors.

Conquest Graphics uses gang-run printing methods whenever possible.

Important: Gang-run printing is a process whereby multiple (and different) customer jobs are combined on a large press sheet, and run at the same time. For example, we may put 4 different customers’ 8.5 x 11 flyers, postcards, and business cards on one press sheet, and then run the sheet 1000 times to get 4 sets of 1000 flyers, postcards, and business cards for each customer order. This process allows us to spread the expensive initial setup cost of running a full-color, offset print project across 4 different customers.

The application of a coating or varnish may affect or change the appearance of the printed colors. Conquest Graphics is not liable for the final color appearance of coated or varnished product.

CUSTOMER-SUPPLIED ARTWORK OR GRAPHICS FILES

All customer-supplied files, including artwork, layouts, and images must be in CMYK color mode. Conquest Graphics is not responsible for color shifts that result from RGB to CMYK conversions.

All customer-supplied files, including artwork, layouts, and images must be at least 300 dpi minimum resolution. Conquest Graphics is not responsible for poor reproduction quality of customer-supplied images that do not meet the stated resolution standards.

REFUNDS AND CREDITS

Conquest Graphics stands behind its work, and we guarantee that you will be satisfied with the quality of our product, or we will reprint your order at no additional charge. Because each project is a unique, custom manufactured product, it has no resale value for anyone other than the party that ordered it. Therefore, all sales are final, and no monetary refunds or credits will be issued. If Conquest Graphics confirms that a manufacturing error or quality defect is our fault, we may elect to re-print the order in lieu of any monetary credits or refunds. No refunds or credits will be issued for logo design, photography, and/or graphic design services.

Conquest Graphics makes every effort to package final products so that they are not damaged in shipment. Sometimes, however, these precautions do not protect the shipped product because of the way the boxes are handled by the shipper. Therefore, Conquest Graphics does not guarantee against damage that is caused by the shipper, though we will assist you in claiming those damages.

RETURN POLICY

You must notify Conquest Graphics of any defects discovered in the ordered product within 6 business days of order acceptance or receipt of the product. In order to receive replacement, you must return (at your own expense) 100% of the received product within 15 calendar days from the time when the ordered product delivery was taken.

All charges related to expedited delivery (Rush Printing or Shipping) are not refundable, including those charges related to orders that are returned for any reason.

SHIPPING, DELIVERY, AND TRANSFER OF TITLE

Conquest Graphics will always act to make sure that any production difficulties do not delay delivery schedules. In no case shall Conquest Graphics be liable for any consequential or damages resulting from any delay in shipment or delivery.

Conquest Graphics will always act to make sure that delivery schedules are met. However, unexpected equipment failure, malfunction, and/or technical problems may delay the manufacturing process. In case of delay caused by technical difficulty, rush charges/fees may be refunded or waived where applicable. However, technical difficulty will not be grounds for order cancellation.

You agree not to hold Conquest Graphics liable for delays in shipments caused by weather conditions, shipping company delays, international customs issues, or any other circumstances beyond Conquest Graphics' direct control. Conquest Graphics shipment and delivery dates are calculated based upon estimates provided by our suppliers.

You agree that the shipping terms for all products are FOB shipping point and ownership transfers from Conquest Graphics to the customer upon shipment. This means that the risk of loss and title for such items pass to you upon our delivery to the Shipper. Conquest Graphics is not responsible for delays, errors, damage, or losses that occur as a result of the shipping process.

Loss or damage claims can only be filed for orders over $50.00 US in value and can only be filed after 30 days from package shipment.

When a shipment is not delivered due to an error made by the customer in submitting the proper shipping address, Conquest Graphics will reship the package with corrected address and charge you for any additional applicable shipping fees.

For products that are provided to the customer in an electronic format, the customer agrees that delivery of such product(s) shall be deemed to have occurred either (a) at the time we transmit the product via email or other electronic transmission or (b) at the time we transmit a notification that the product is available for downloading from one of our servers.
